SESSIONS ON THE UNIFORM ACT ON INSOLVENCY LAW

After the presentation of the general trends of Ohada reform mostly aiming at avoiding the economic and social setbacks resulting from the defaults of insolvent debtors and at allowing the recovery of their undertakings, have been reviewed the innovations and implementation problems, before coming back, with more details, on one typical proceedings : the one concerning debtors under administration supervised by court.

Among the implementation problems raised, were notably raised :

- the lack of publicity of some rulings granting the benefit of a insolvency status to insolvent debtors,

- some problems with insolvency proceedings under voluntary agreement used by some debtors to stop their creditors' legal proceedings,

- the dictatorial management of such proceedings by receivers.

The sessions went on with the more detailed review of the proceedings mentioned above, the surroundings of which needed to be mastered. This phase of the session has been accompanied by the review of some practical documents in order to help the attendants with the day-to-day management of such proceedings.
