A FEW WORDS ON AGOA


African Growth and Opportunity Act included in The May 18, 2000 Trade and Development Act, provides for the African countries meeting some requirements a preferential access to the US market. These countries notably undertake to make continued progress toward a market-based economy, the rule of law, free trade, poverty reducing economic policies, and the protection of workers' rights.

AMONG THE BENEFITS FROM AGOA
Provisions on apparel

Provision is made for duty-free and quota-free access to the U.S. market without limits for apparel made in eligible Sub-Saharan African countries from U.S. fabric, yarn, and thread. The Act also provides for substantial growth of duty-free and quota-free apparel imports made from fabric produced in these countries. Under AGOA I, apparel imports made with regional (African) fabric and yarn are subject to a cap of 1.5% of overall U.S. apparel imports, growing to 3.5% of overall imports over an 8 year period. AGOA II doubles the applicable percentages of the cap. Moreover, under a Special Rule for Lesser Developed Beneficiary Countries, those with a per capita GNP under $1,500 enjoyed duty-free access for apparel made from fabric originating anywhere in the world until September 30, 2004.
ELIGIBLE AFRICAN COUNTRIES IN THE OHADA ZONE


The list of these eligible countries was as follows in January 2005 :

South Africa, Angola, Benin, Botswana, Burkina Faso, Cameroon, Cape Verde, Congo, Democratic Republic of Congo, Djibouti, Ethiopia, Gabon, Gambia, Ghana, Guinea, Guinea-Bissau, Kenya, Lesotho, Madagascar, Mawi, Mali, Mauritania, Mauritius, Mozambique, Namibia, Niger, Nigeria, Uganda, Rwanda, Sao-Tome, Senegal, Seychelles, Sierra Leone, Swaziland, Tanzania, Chad et Zambia.
